Cloth Foundation and Cloth Programming Language

By accessing, downloading, installing, or using any software, services, or content provided by the Cloth Foundation ("Cloth Foundation," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.
These Terms constitute a legally binding agreement between you and the Cloth Foundation. We reserve the right to modify these Terms at any time, and your continued use of our services after such modifications constitutes acceptance of the updated Terms.
All software, tools, documentation, websites, forums, and other resources provided by the Cloth Foundation, including but not limited to the Cloth programming language, compiler, development tools, and community platforms.
Any individual, organization, or entity that accesses, downloads, installs, or uses our Services.
Any information, data, text, software, code, documentation, or other materials made available through our Services.
Any code, documentation, bug reports, feature requests, or other materials submitted to the Cloth Foundation or its projects.
The Cloth Foundation provides the following services:
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without notice.
The Cloth Foundation retains all rights, title, and interest in and to our Services, including all intellectual property rights. Our Services are protected by copyright, trademark, and other intellectual property laws.
Much of our software is distributed under open source licenses (MIT License and Apache License 2.0). The specific license terms for each component are provided with the software and take precedence over these Terms.
By submitting Contributions to our projects, you grant the Cloth Foundation a perpetual, irrevocable, non-exclusive, royalty-free license to use, modify, distribute, and sublicense your Contributions under the same license as the project to which you are contributing.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
We may collect certain information about your use of our Services, including usage statistics, error reports, and feedback. We do not collect personal information unless you voluntarily provide it.
We implement reasonable security measures to protect your information, but we cannot guarantee absolute security. You use our Services at your own risk.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CLOTH FOUNDATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES.
WE DO NOT GUARANTEE THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT.
You may stop using our Services at any time. Termination of your use does not affect any rights or obligations that have already accrued.
We may suspend or terminate your access to our Services immediately, without prior notice, if you violate these Terms or engage in conduct that we determine to be harmful to our community or Services.
Upon termination, your right to use our Services ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, United States.
You agree that any arbitration or legal proceeding shall be limited to the dispute between you and the Cloth Foundation individually. You waive any right to participate in class action lawsuits or class-wide arbitration.
These Terms, together with our Privacy Policy and any applicable open source licenses, constitute the entire agreement between you and the Cloth Foundation regarding your use of our Services.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms without restriction.
